На этот раз обвинение не было снято, и против него выступало ФБР. Его дело развалилось окончательно, когда кассирша банка, заметив, что на руках Талли не было родинок, которые она видела у проходившего мимо стойки грабителя, сказала на суде: “Это не тот человек, который меня ограбил”. Талли возбудил иск о компенсации на сумму 10 миллионов долларов.
